Welcome to EnergyAir Professional Services! These Terms of Service govern your use of our services and establish the contractual relationship between you and EnergyAir. Please read these terms carefully before using our services.
1. Acceptance of Terms
By engaging EnergyAir Professional Services for any HVAC, refrigeration, electrical, plumbing, cold room, or welding services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Services Offered
EnergyAir Professional Services provides the following professional services throughout Malawi:

Emergency Services
We provide 24/7 emergency services for critical system failures. Emergency service rates may apply outside normal business hours.
3. Service Agreements and Quotes
Free Estimates
- We provide free estimates for most services
- Estimates are valid for 30 days unless otherwise specified
- Complex projects may require site visits for accurate estimates
- Emergency service calls may incur diagnostic fees
Service Authorization
- Written authorization required for work exceeding quoted amounts
- Customer signature or verbal approval required before beginning work
- Changes to scope of work must be approved in writing
- Additional charges for work beyond original scope will be communicated
Important: Emergency repairs may proceed without prior written authorization to prevent property damage or safety hazards. Customer will be notified as soon as reasonably possible.
4. Payment Terms
Payment Methods
- Cash payments accepted
- Bank transfers and mobile money
- Business checks (subject to verification)
- Credit arrangements for qualified commercial customers
Payment Schedule
- Residential Services: Payment due upon completion
- Commercial Services: Net 30 days for approved accounts
- Large Projects: 50% deposit, balance on completion
- Emergency Services: Payment due immediately
Late Payment
- Late payment fees of 2% per month on overdue amounts
- Services may be suspended for accounts over 60 days past due
- Collection costs and legal fees may be added to delinquent accounts
5. Warranties and Guarantees
Service Warranty
- Labor Warranty: 90 days on all service work
- Parts Warranty: Manufacturer warranty period (typically 1-5 years)
- System Installation: 1 year warranty on new installations
- Cold Room Construction: 2 years on structural work, 1 year on equipment
Warranty Conditions
- Warranty covers defects in workmanship and materials
- Customer must provide reasonable access for warranty service
- Warranty void if system is modified by unauthorized persons
- Normal wear and tear not covered under warranty
- Warranty service must be performed by EnergyAir technicians
Warranty Exclusions
- Damage due to misuse, neglect, or improper maintenance
- Acts of nature (lightning, floods, earthquakes)
- Power surges or electrical issues beyond our control
- Vandalism or accidental damage
- Modifications made without our authorization
6. Customer Responsibilities
Access and Safety
- Provide safe and reasonable access to work areas
- Clear work areas of personal belongings and obstacles
- Inform technicians of any safety hazards or concerns
- Ensure adequate lighting and ventilation in work areas
- Provide accurate information about existing systems
Property Protection
- Remove or protect valuable items in work areas
- Secure pets during service visits
- Notify us of any special property considerations
- Report any concerns immediately during service
Maintenance Requirements
- Follow recommended maintenance schedules
- Use only recommended filters and parts
- Report issues promptly to prevent further damage
- Allow annual inspections for warranty maintenance
7. Limitation of Liability
EnergyAir Professional Services' liability is limited as follows:
Maximum Liability
- Our liability shall not exceed the amount paid for the specific service
- We are not liable for consequential or indirect damages
- Lost profits, business interruption, or similar damages are excluded
- Our insurance coverage provides additional protection as available
Property Damage
- We carry comprehensive liability insurance
- Property damage claims must be reported within 48 hours
- Photographic evidence may be required for claims
- Pre-existing damage will not be covered
Important: Some jurisdictions do not allow limitation of liability for certain damages. These limitations may not apply to you where prohibited by law.
8. Cancellation and Rescheduling
Customer Cancellations
- Same Day: Service call fee may apply
- 24 Hours Notice: No cancellation fee
- Emergency Calls: Cancellation fee applies if technician dispatched
- Scheduled Installations: 48 hours notice required
EnergyAir Cancellations
- We will provide as much notice as possible
- Priority rescheduling for cancelled appointments
- Weather-related cancellations for safety reasons
- Emergency situations may require schedule changes
9. Compliance and Licensing
Professional Standards
- All work performed according to Malawi building codes
- Licensed and insured professional technicians
- EPA certified for refrigerant handling
- Compliance with local electrical and plumbing codes
- Regular training on industry best practices
Permits and Inspections
- Customer responsible for obtaining necessary permits
- We will assist with permit applications when required
- Additional fees may apply for permit expediting
- Work may be subject to municipal inspections
10. Environmental and Safety Policies
Environmental Responsibility
- Proper disposal of refrigerants and hazardous materials
- Recycling of old equipment and components
- Energy-efficient solutions recommended
- Compliance with environmental regulations
Safety Protocols
- All technicians trained in safety procedures
- Personal protective equipment used as required
- Lockout/tagout procedures for electrical work
- Regular safety training and updates
11. Dispute Resolution
Resolution Process
- Step 1: Direct communication with service manager
- Step 2: Formal written complaint and investigation
- Step 3: Management review and resolution attempt
- Step 4: Third-party mediation if necessary
Governing Law
These terms are governed by the laws of Malawi. Any disputes will be resolved in the courts of Malawi, with venue in Lilongwe.
12. Modifications to Terms
EnergyAir reserves the right to modify these Terms of Service at any time. Changes will be effective upon:
- Posting updated terms on our website
- Email notification to active customers
- Notice provided during service appointments
- 30 days after notification for material changes
Continued use of our services after changes constitutes acceptance of the modified terms.
13. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
